Showcaseful is a platform for sharing content, allowing creators to link their audiences with their latest and most relevant work, products and services. We value intentional simplicity, which is why we've streamlined our terms and conditions into a clear and approachable format here.
1. Welcome to Showcaseful!
We're thrilled you're here. These Terms, together with the associated policies, regulate your use of our services—including the website (https://showcaseful.com/), applications, and related software or features (collectively called the "Platform" or "Showcaseful").
In these Terms, "we," "our," or "us" refers to Showcaseful (operated by Unique-P GmbH in Switzerland). By accessing Showcaseful, you accept these Terms & Conditions ("Terms") and the additional policies referenced here and on the Platform. Please review these Terms thoroughly, and don’t hesitate to contact us with any questions. If you disagree with these Terms, kindly refrain from using Showcaseful.
2. Updates to These Terms
Showcaseful is always advancing and refining its offerings. Occasionally, we may adjust the Platform or these Terms. Updates to these Terms might occur to align with business developments, modifications to the Platform (such as discontinuing features or functions), legal or commercial needs, or to safeguard our legitimate interests. We reserve the right to revise these Terms at any time, and it’s up to you to periodically review them for changes.
For significant updates, we’ll inform you at least one month prior to their effective date (e.g., through a Platform notification). Continuing to use the Platform after revisions implies your consent to the updated Terms. If you don’t accept the changes, please discontinue using Showcaseful and close your account.
3. Your Account
To register as a Showcaseful user, you must be 18 or older. If you’re setting up an account for someone else, you need their approval. You’re accountable for your account and must ensure its use complies with the law. By creating an account, you agree to follow these Terms, confirm you’re over 18, and are legally able to enter this agreement. Provide us with truthful information about yourself, and update us if anything changes.
If you’re using Showcaseful for a business or another individual, you affirm you’re authorized to accept these Terms on their behalf. You’re responsible for all activity on your account, so protect your login credentials and keep them confidential.
If you suspect your account has been breached, notify us immediately. You may not transfer your account to another person or use it (or permit its use) in a way that, in our fair judgment, harms Showcaseful, our reputation, or violates others’ rights or applicable laws.
4. Your Showcase Profile Handle
Upon creating a Showcaseful profile, select a handle that’s appropriate and respects others’ rights. We recognize your handle’s importance, but it must suit all users and not infringe on rights, including intellectual property (IP) rights like copyrights or trademarks. You cannot adopt someone else’s name—such as a celebrity or brand—or choose an offensive, crude, or irrelevant handle solely to profit later (known as "Domain Squatting").
If problems emerge with your handle, we’ll review the matter equitably and may request a change (it could also be reassigned). Refusal to comply may lead to account suspension or termination. If someone alleges your handle breaches their IP rights, they must submit an Intellectual Property report, and you can reply with a Counter Notice. If your account shows no logins, new links, or traffic for six months, we might reclaim or reassign your handle (after notifying you first).
5. Managing Your Plan
You can join Showcaseful on a free or paid plan and cancel anytime. Your plan begins when you accept these Terms and lasts until you end it. Canceling a paid plan typically continues until your current billing cycle concludes, then shifts to a free plan. To cancel, go to the billing page (found in the top-right menu in the app). Payments are generally non-refundable under applicable law, but if you cancel a paid plan within 72 hours, we might offer an exception (email us at [email protected]).
6. Your Content
We celebrate the diverse content our users share on Showcaseful! To ensure a safe experience for all Platform visitors, we’ve established Community Standards. These outline acceptable and prohibited content, so please adhere to them, or we may suspend or permanently delete your account.
"Your content" includes text, images, videos, links, products, and other materials you upload to your Showcaseful profile. You’re accountable for your content and assure that:
- It’s yours, or you have the rights to use third-party materials on Showcaseful (and permit our use as outlined in these Terms).
- It doesn’t violate anyone’s privacy, publicity, intellectual property, or other rights.
- It’s truthful and non-deceptive, complies with laws, and doesn’t damage our reputation.
- It’s free of harmful components like viruses or disruptive code that could affect the Platform or other systems.
- It avoids automated data collection tools, such as scripts or scrapers, to harvest info from profiles or the Platform.
- You won’t post unauthorized ads, solicitations, or endorsements.
- It complies with our Community Standards.
Given varying laws across regions, we may restrict content legal in some areas but not others. We reserve the right to remove or limit access to content to maintain Platform safety, notifying you unless legally barred or in urgent cases.
7. Our Use of Your Content
We admire your content and aim to highlight it. By posting on your Showcaseful profile, you grant us a worldwide, royalty-free, perpetual license to (i) use, display, distribute, modify, adapt, and create derivatives of your content; and (ii) use your name, image, voice, photo, likeness, and other personal traits in the content on the Platform and in our marketing across all media (like social channels and ads). This means we can use your content globally, without fees, indefinitely. You confirm you hold all necessary third-party rights to post the content and grant this license.
You retain ownership of your content. Note that it will be publicly viewable and may be shared by others on Showcaseful and beyond.
Avoid sharing sensitive personal details on Showcaseful that you don’t want public, like social security or passport numbers. Only post another’s personal info with their consent, keeping a record of it. We aren’t obligated to verify your content’s accuracy, reliability, or legality, though we may opt to. We can alter, remove, or restrict content per these Terms.
8. Monetizing Your Content
You might join a Showcaseful monetization program or use monetization features. We’ll notify you via email or another agreed method if so.
- Geographic Location – Eligibility for monetization features requires residing in an approved country. Moving elsewhere may revoke access.
- Email Verification – You must verify your email with Showcaseful to use monetization features.
- Good Standing – Violations of these Terms, Community Standards, or linked policies may restrict your monetization eligibility or access.
- Commissions – Showcaseful may secure commission rates with brands or merchants for affiliate sales via the Platform. Rates can change anytime and are shown in your dashboard. We might lock your rate for a period, notifying you accordingly. For independent affiliate sales (e.g., via third-party programs), Showcaseful isn’t liable for commission payments or your ties with those networks.
- Commission Disclosures – You must legally disclose commissions from affiliate links or transactions. We’ll disclose if Showcaseful earns a commission too. You agree to follow your region’s disclosure laws and not disable our disclosure tools (e.g., ‘commissionable links’ banners). Showcaseful isn’t liable for losses from your non-compliance.
- Paid Partnership Disclosure – For third-party partnerships outside Showcaseful’s Linker monetization, disclose per legal requirements. Don’t disable our disclosure aids (e.g., ‘paid partnership’ banners). Showcaseful isn’t responsible for losses from your non-compliance.
- Gifts – If promoting gifted items, disclose as required by your region’s laws. Showcaseful isn’t liable for losses from non-compliance.
- Payment – We pay monthly for funds earned via monetization partners, updating you on schedule changes. "Available funds" are closed commissions paid to Showcaseful from your sales, minus fees. Pending commissions appear in your dashboard until confirmed as closed (final, non-reversible). You may need a third-party payment account (e.g., Stripe, PayPal), subject to their terms. Payments require completing their KYC process. If your monetization access ends, closed commissions are paid, but pending ones may be lost.
9. Account Suspension or Cancellation
Failure to comply with these Terms, Community Standards, or linked policies may lead us to suspend or terminate your Showcase profile or account, or adjust its functionality. For instance, late fee payments might downgrade your paid plan to a free one, or misuse of Linker Monetization could cut feature access.
Actions depend on the violation’s severity. Minor issues might not trigger suspension or cancellation, but repeated or major breaches could. We’ll notify you before suspending or canceling, unless the breach is critical or immediate action is legally required.
No refunds apply for prepaid fees, and we’re not liable for content lost due to suspension, cancellation, or downgrading. If you think your account was wrongly canceled or have concerns about these Terms or the Platform, contact [email protected]. We’ll strive to resolve issues amicably within a month before any legal steps.
10. Responsibility for Visitors and Customers
You’re accountable for your profile’s visitors, including customers buying through it—collectively "End Users." You alone handle (i) End Users’ interactions with your profile and content, and (ii) compliance with laws related to End Users and transactions via your profile (e.g., using “Commerce” or “Payment lock” features). Showcaseful isn’t liable for products or services sold via the Platform.
Donations via our “Support Me” feature are voluntary, with no goods or services expected in return. Use it solely for personal donations, not charity or cause fundraising.
11. Feedback
We welcome your suggestions to enhance Showcaseful! We might offer “beta” features and request feedback. If you provide input, we can use it freely without compensating you (or opt not to use it). Beta features are under testing and may be less reliable than other Platform areas.
12. Our Platform
As Platform owners, we grant you a limited right to share and engage with content. We’re not responsible for content, products, or services from other users’ profiles. All rights, including Intellectual Property (IP) Rights, in the Platform (excluding your content)—termed "Showcaseful IP"—belong to Showcaseful or our licensors. You gain no rights in Showcaseful IP and can’t use it, including our brand or logo, without prior written consent, like suggesting a partnership or endorsement.
We provide a limited, revocable, non-exclusive, non-transferable right to use the Platform for creating, displaying, and uploading content per these Terms.
Any images, icons, themes, fonts, videos, or graphics we supply are for profile use only, following our guidelines. Don’t obscure or alter proprietary notices or trademarks. Copying, distributing, selling, modifying, reverse-engineering, or deriving the Platform’s source code is prohibited.
As a “profile visitor,” you get a limited, non-exclusive, non-transferable right to view and interact with profiles. To the extent legally allowed, we’re not liable for opinions, advice, products, or other content on user profiles.
14. Fees and Payment
- Subscription Fees: – For paid plans, pay fees promptly, typically in USD, including taxes like GST/VAT unless noted. Fees are charged upfront, recurring monthly or annually per your choice. Plans auto-renew under current Terms unless canceled. Submit accurate billing info and a valid payment method (e.g., credit card) upon signup, authorizing charges. If billing fails, we’ll notify you with a grace period to update; persistent failure downgrades your profile to free.
- Showcaseful Transaction Fees: – Transactions via your profile (e.g., commissions, sales, Linker Monetization) may incur percentage-based fees, detailed on our pricing page. Alternative fee methods will be shared if applicable. Fees deduct from transaction amounts before crediting you. You’re liable for external fees, taxes, and income taxes on payments received.
- Processing Fees: – External processors (e.g., PayPal, Stripe, Square) handle transactions, charging fees per their terms, which you must review and accept. Fees deduct from proceeds before you receive them. Showcaseful isn’t responsible for these fees.
- Fee Changes and Notice: – We may adjust fees, providing at least one month’s notice. If you disagree, cancel before the next billing cycle.
15. Tax Requirements
If monetizing your profile, you’re responsible for tax compliance in your region. Showcaseful isn’t liable for losses from your non-compliance.
16. Privacy
Protecting your privacy and that of Profile Visitors is key at Showcaseful. Our Privacy Policy details how we manage your and visitors’ personal data. Creating an account means you’ve read, understood, and agreed to it.
Data (including IP rights) from your or others’ Platform use belongs to Showcaseful. We may share Data or “Data Analytics” visuals with you, striving for accuracy without guaranteeing it.
17. Confidentiality
We might share confidential info (e.g., upcoming features during beta testing). Keep it secret and secure, using reasonable safeguards. If beta participation allows public sharing, we’ll clarify what’s permissible.
18. Recommended Content
Showcaseful may suggest products or content based on your data and others’ usage. These aren’t endorsements by Showcaseful.
19. Liability
You use the Platform at your own risk, maintaining your content backups. We’re not liable for damages from downloading, using, or sharing Platform content. You must protect your data and devices.
You agree to shield us from losses due to your breach of these Terms or third-party claims about your content. Neither party is liable for indirect, punitive, or consequential damages (e.g., lost profits or data), even if foreseeable. Our liability caps at the greater of fees you paid us in the prior 12 months or $80.
20. Disclaimers
Using Showcaseful and its content is at your risk. The Platform is offered “AS IS” and “AS AVAILABLE,” without warranties—express or implied—like uptime, merchantability, or fitness for purpose.
Showcaseful, its affiliates, and licensors don’t guarantee:
- Uninterrupted, secure, or constant availability;
- Error or defect fixes;
- Absence of viruses or harmful elements;
- Effectiveness or fulfillment of your needs;
- Accuracy, reliability, or suitability of content.
These Terms apply as legally permitted, not overriding unwaivable rights.
21. Third Party Services
We integrate with third-party services (e.g., payment portals, stores). Unless stated, we don’t endorse or warrant these, nor refund third-party payments. You must review and follow their terms; non-compliance may limit your Platform access. Third-party terms, if required, appear at this page’s bottom, with subprocessors listed in our Privacy Policy.
22. A Few Last Things
Local laws may apply, overriding conflicting Terms to that extent.
These Terms, with the Privacy Policy and linked policies, form our complete agreement, excluding implied terms unless legally mandated. Invalid provisions are severed in affected regions, leaving the rest intact.
Governed by Canton Solothurn and Swiss law, we both submit to their courts’ exclusive jurisdiction. Non-enforcement isn’t a waiver. No agent/principal relationship arises.
